Terms of Service

These Terms govern your use of the SprayBoard mobile app and this website (together, the “Service”). By creating an account or using the Service, you agree to them. If you do not agree, do not use the Service.

1. Climbing is dangerous

Read this section before you use SprayBoard. Climbing — indoors, on a board, or anywhere else — carries inherent risks, including falls, serious and permanent injury, paralysis, cardiac events, and death. Those risks cannot be eliminated.

SprayBoard is a logbook and a tool for lighting up holds. It is not instruction, coaching, training advice, or a safety system. A climb appearing in the app is not a representation that it is safe for you, that its grade is accurate, or that the wall or its holds are correctly installed and maintained. We do not inspect any board, and we are not responsible for the condition of any wall, hold, LED system, mat or facility.

You are solely responsible for your own safety: for getting proper instruction from a competent instructor, for assessing every climb and every wall yourself before attempting it, for warming up, and for deciding what is within your ability. You climb at your own risk.

2. Eligibility and your account

  1. You must be at least 13 years old to use the Service. If you are under the age of majority where you live, you may use it only with the consent of a parent or guardian.
  2. You sign in with a one-time code sent to your email address. Keep access to that email address secure — anyone who can read it can sign in as you. You are responsible for everything that happens under your account, and you may not share it or let someone else use it.
  3. Provide accurate information, and keep it accurate. Do not impersonate another person, gym or brand, or misrepresent your affiliation with one.

3. Content you post

  1. You keep what you make. Climbs you set, comments you write, photos you upload and every other contribution (“Your Content”) remain yours.
  2. The licence you give us is only what running the app requires. You grant SprayBoard a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, display and distribute Your Content within the Service, and to make the technical changes needed to do so (resizing an image, for example). We will not sell Your Content or license it to third parties for their own purposes. This licence ends when you delete the content or your account, except as described in section 3(d).
  3. You are responsible for Your Content, and you confirm you have the rights needed to post it.
  4. Published climbs are shared. A climb, once published, becomes part of the shared pool for that board layout and other climbers can log ascents on it. Deleting your account will not remove a published climb that others have already climbed, because that would erase their logbooks too. Drafts are private and are yours to delete at any time.

4. Objectionable content and abusive behaviour

There is zero tolerance for objectionable content or abusive behaviour on SprayBoard. Content that is harassing, threatening, hateful, defamatory, obscene, sexually explicit, violent, or that targets a person or group on the basis of race, ethnicity, national origin, religion, disability, sex, gender identity, age or sexual orientation, is prohibited — in climb names, descriptions, comments, usernames, profile pictures and every other part of the Service.

You can report any climb from its ⋯ menu. Reports are reviewed and objectionable content is removed, and accounts that post it are suspended or terminated — typically within 24 hours of a report. You can also block a climb to remove it from your own view immediately, without reporting it.

  1. We may remove content, and suspend or terminate an account, where we reasonably believe these Terms have been broken — including immediately, and without notice, for objectionable content or abusive behaviour.
  2. You may stop using the Service at any time and delete your account from Profile → Settings → Delete Account.

7. Boards, brands and climb data

  1. SprayBoard works with boards made by other companies. It is not affiliated with, endorsed by, or sponsored by Aurora Climbing, Moon Climbing, or any board manufacturer. Board and product names are the trademarks of their respective owners and are used only to describe hardware compatibility.
  2. If you are the creator of a climb and would like it removed, or you believe content on the Service infringes your copyright, contact us at itaiaxelrad@gmail.com and we will address it promptly.

8. The Service is provided as is

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTY OF ANY KIND, EXPRESS, IMPLIED OR STATUTORY, INCLUDING THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE, THAT ANY GRADE, CLIMB OR OTHER DATA IS ACCURATE, OR THAT DATA WILL NOT BE LOST.

9. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, SPRAYBOARD WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA OR GOODWILL, ARISING OUT OF YOUR USE OF THE SERVICE — INCLUDING ANY INJURY SUSTAINED WHILE CLIMBING. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE PRECEDING TWELVE MONTHS OR FIFTY US DOLLARS ($50).

Some jurisdictions do not allow the exclusion of certain warranties or liabilities, so parts of sections 8 and 9 may not apply to you. Nothing in these Terms limits liability that cannot be limited by law.

10. Changes

We may update these Terms. Material changes will be reflected in the date at the top of this page, and continuing to use the Service after a change means you accept the updated Terms.

11. Governing law

These Terms are governed by the laws of the United States and the State of Colorado, without regard to conflict-of-laws rules.
